UPDATED: Gov. Baldacci discusses Question 1 on the Rachel Maddow Show

by: Gerald Weinand

Fri Oct 30, 2009 at 11:00:00 AM EDT

Last night Rachel Maddow interviewed Gov. John Baldacci about Question 1, the so-called people's veto of Maine's law that would allow same-sex couples to marry:

Update: It is of interest to contrast the position taken by Gov Baldacci when signing LD 1020, that his own view of same-sex marriage had changed when he really reflected on it, and the sudden claim by Marc Mutty and everyone else at S4MM that domestic partnerships are an acceptable alternative to equal marriage, so sudden in fact that they forgot to explain their conversion:

Is it legal for the legislature to pass the bill again if it is people's vetoed? (0.00 / 0)
Or is there a certain time limit before it can be taken up again?

The question to ask is... (0.00 / 0)
Once they have tried to repeal a people's veto for a law and FAILED, can they try again? Or will this be it. The law was passed in May and withstood a challenge at the ballot box. End of story. I hope....I believe.

I think it's pretty clear (0.00 / 0)
that they cannot try again.  The veto petition must be presented within a certain time period, and that time period has passed.

I can't find anything in the Maine consitutution that prohibits the Legislature from immediately passing the bill again, should the people's veto succeed.  Of course, it would be subject again to a people's veto petition and vote.

Contrast that to California where there are limits on what the Legislature can do wrt a referendum once it is passed.  They can't just turn around and nullify it, IIUC.

Sort of like overturning a governor's veto, (0.00 / 0)
except I can't imagine any Legislature doing so.

Bellows v. Frary (0.00 / 0)
For those of you with an hours free time (if I may ad, at an hour when cocktails have already been served), this debate between MCLU Executive Director Shenna Bellows, representing NO on 1, and Prof. John Frary, ostensibly representing the Yes on 1 campaign. I'm really curious as to whom approved Frary's appearance, as - well, watch for yourself:
